No trial date has been set. They'll walk away from Joe Nemer property if they the suit is not reversed or if Joe doesn't settle for less. Rasor, I'm of the opinion that land and business loss is no where close to $85 per square foot. If, UofA is willing to pay 1.75 mil and Joe says no. Then that is greed. So I'm assuming that is pending the appeal and the potential of the value not being reversed. However it never really says they won't still pursue Manny's properties. So maybe I'm reading the article wrong but it looks to me like it would play out like this, if the appeal ends up with the same results, walk away from Joe's, then go after Manny's. They would have to pay all legal fees and damages which current estimates say about 100,000 plus in legal fees alone for Joe Nemer and about 50,000 plus in legal fees for Manny and damages. They'd still be out close to half million just to walk away from this. I'm betting that the case as Mendenhall feels they have an rock solid case and I seriously doubt Manny or Joe would settle for less then the judgment awarded Joe Nemer.
